Welcome to Quickie, operated by Quicker Media Inc. These Terms of Service (TOS) govern your use of the Quickie platform. By accessing or using Quickie, you agree to these terms. Please read them carefully.

Interpretation

  • Quickie: The platform accessible via www.quickie.app.
  • Content: Any material uploaded by users, including videos, images, text, etc.
  • Performer: A user who uploads content to Quickie.
  • Subscriber: A user who pays for access to content on Quickie.
  • User: Anyone using Quickie, either as a performer or a subscriber.
  • Qualified View: A view of content that meets the criteria set by Quickie for compensation.

Changes to the Terms of Service

We may modify these TOS as needed to reflect changes in our services or legal requirements. Users will be notified of significant changes via email or through the platform. Continued use of Quickie after changes are made constitutes acceptance of the new terms.

Service Availability

Quickie may be updated, changed, or interrupted for maintenance, improvements, or other reasons. We strive to provide reasonable notice for major changes or interruptions but cannot guarantee uninterrupted service.

Registering with Quickie

To use Quickie, you must first register and create a user account. You must provide a valid email address, a username, and a password. Your password should be unique and comply with the technical requirements of the Quickie site.

  • Eligibility: Users must be at least 18 years old and provide accurate, truthful information during registration. You must be permitted by the laws of your jurisdiction to use Quickie.
  • Account Security: Users are responsible for maintaining the confidentiality of their account information and are liable for all activities that occur under their account. Notify Quickie immediately of any unauthorized use of your account.

User Commitments and Responsibilities

By using Quickie, you agree to:

  • Provide accurate, truthful, and complete information.
  • Update your information as necessary.
  • Comply with all applicable laws and ethical standards.
  • Respect the rights of other users and third parties.
  • Not use Quickie if your account was previously terminated or suspended.
  • Abide by our Acceptable Use Policy for prohibited content and behavior guidelines.

Rights of Quickie

Quickie reserves the right to:

  • Suspend or terminate accounts for violations of these TOS or other policies.
  • Moderate and review content to ensure compliance with our policies and legal requirements.
  • Investigate suspected violations and take appropriate action, including content removal and account termination.
  • Change the third-party payment providers used to process payments on Quickie.

Content Ownership and Licensing

  • Ownership: Performers retain ownership of their content.
  • License: Performers grant Quickie a temporary, revocable, non-exclusive license to use, display, and distribute their content on the platform. Performers may revoke this license by providing written notice to Quickie.

Subscriber Payments and Transactions

  • Subscription Fees: Subscribers pay a monthly fee to access content. The subscription fee is determined by Quickie.
  • Payment Processing: Payments are processed through third-party payment providers. Subscribers agree to provide accurate payment information and authorize Quickie to charge their payment method for subscription fees.
  • Refunds and Chargebacks: Subscribers may request refunds or initiate chargebacks for unauthorized transactions. Quickie reserves the right to investigate and handle such requests at its discretion.

Performers’ Earnings

  • Calculation of Earnings: Performers earn a percentage of subscription fees based on the Qualified Views of their content. The exact calculation method is detailed in the Performer Agreement.
  • Payment Disbursement: Earnings are disbursed to performers’ designated payment accounts according to the schedule and method specified in the Performer Agreement.

What We Are Not Responsible For

  • Content Responsibility: All content on Quickie is created and provided by users. Quickie does not review, endorse, or verify user content.
  • Views and Opinions: The views and opinions expressed by performers or subscribers on Quickie do not reflect those of Quickie.
  • Third-Party Use: Once content is posted on Quickie, it may be shared or recorded by others. Quickie cannot control or be held responsible for third-party actions.
  • Security: While we strive to keep Quickie secure and free from harmful elements, we cannot guarantee absolute security. Users are responsible for implementing their own security measures.
  • Service Availability: We do not guarantee that Quickie will always be available or that access will be uninterrupted.
  • User Identification: Users may be identified from their content. Quickie is not responsible if you are identified from your content.
  • Technical Issues: Quickie is not liable for any issues arising from internet availability, user devices, or other external factors.
  • Earnings: Quickie makes no guarantees regarding the earnings of performers or referral program participants.
  • Legal Compliance: Users are responsible for ensuring their use of Quickie complies with applicable laws.

Account Suspension and Termination

Quickie reserves the right to suspend or terminate user accounts for violations of these TOS or other policies. If your account is suspended or terminated, you will be notified via email or through the platform.

Governing Law and Dispute Resolution

These TOS are governed by the laws of Canada. Any disputes arising from or relating to these TOS or your use of Quickie will be resolved through binding arbitration or mediation, as agreed upon by both parties.

Miscellaneous

  • Severability: If any provision of these TOS is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
  • Waiver: Our failure to enforce any right or provision of these TOS will not be considered a waiver of those rights.
  • Entire Agreement: These TOS, along with the Privacy Policy and Performer Agreement, constitute the entire agreement between you and Quickie regarding your use of the platform.

By using Quickie, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
